UPDATED !! List of ripped off by Theothergary (Gary Chaboya) or Fan_made on ebay.

I know i really do hate to say it but this seems to be the guys tactics. He must like this. I cant explain it, he would send me several emails then nothing then i called him he answered promised to fix things then nothing, then text same M.O. then nothing now i cant get a single cheap insult from the guy.

Sounds to me like the guy has serious issues with his finances, in other words, takes the money and spends it, then, when time comes around to getting the items to his customers has to use the money from other purchasers.

As a seller myself, you have to ensure that your promises are kept and the money given covers the expense of making the item or you get caught in a bind. The other thing is, as I know from personal experience, if you get a lot of orders and don't have the time to fulfil them within a reasonable time then you ensure that you keep your customers informed. There's nothing worse than refusing to speak to a customer in the hope they go away!

I really commend you all for sticking together and working to get the issue resolved in a mature and reasoned manner!

he still hasn't contacted me after i sent stuff and after madrid sent an email on my behalf. I have really chalked this one up to a loss, I just pray that legally one of the sights we contacted charges him with something. good luck guys cause i know this guy is never going to contact us back.

Maybe you are right. With our claims filed, we should think about taking again our legal action on. If you live in the US, it should be easyer to contact again the local police and the FBI..... andlet them know that we did try to solve it but that should be th FBI or the police who should carry on with this.

On Thu, 9/2/10, i did contact him and next day he told me that he was going to solve all the problems. Today it is 20th, and none of us have received anything....

I am going to send him our last email. I am going to tell him that he has 4 days in order to give us a proof that he is sending at least to 3 of us all the parts that we bought. If he does not do anything about it, we will contact again the FBI and the local police in order to continue what we started.

I always give an opportunity, but this is getting to far.....

I will let you know if there is any news.....

I got the answer from the Real Gary Chavoya, saying that he has nothing do do with him, and that another member of this forum did contact him about the same thing.

So far, i think that the only thing that we can do is to stop by his office (we have his address), and talk to him face to face. I wish that i could do that, but i am afraid that a big ocean does not let me do it. One of us that lives close enough, should do us a favor and stop by to talk to him....

Also, it would be great to find out his real name and adress, in order to find new ways of recovering our money.

I ordered and paid my items one year ago, and he was all the time saying that my items were shipped, and every time that i did contact him, he keep on saying the same..... that is why i do not trust him now. Me and the rest of the forums members have had the same problem, and as far as i know, none of us has got a single item.

We gave him the last chance a few months ago, and like i said, none of them got anything. Then what we did was to file a claim against your name (the name he gave us) with the FBI and the Local Police dept. I have no problem about telling the other members the truth, and tell the FBI and Police that you are not the one... but we need the real name of this person. Think that you have to protect yourself, and that giving us his name is the correct thing, so we can change the name on the claims (FBI and police), so that way you will not have any legal problem. If something happens, it will be in your file for a long time, and even getting a job will not be easy!!!

Please think about it.

I hate to say it..but I think this guy has no intention of refunding your money or sending you the product. Rip off/con artists will lie & say anything in order to stall for time, and then they'll try to disappear & hide from their former customers. (This is how they work.) This is why you shouldn't hesitate any longer, and take this matter as soon as possible to the law enforcement authorities, and to a lawyer. If you give him any more chances & more warnings, he'll just take take advantage of you. Many con artists are counting that you will eventually give up & won't do anything about it. (And they get to keep your money.)

I have no idea why I just read this entire thread, but sadly I did. First of all, I don't believe that what you're suggesting is the right way to go about handling this. This isn't an episode of Magnum PI. Get the police or other authorities involved locally, give them all of your information, give them your receipts, hand it off to them, and then contact them for updates to the case. They should be your point of contact from that point on. Running off on your own to confront someone or telling someone else to do it for you since you live in a different country is a great way to get someone hurt. It only takes the person being confronted to feel threatened and do something stupid and hurt someone.

Short answer: Turn it over to the authorities and let them handle it.

Will you listen? Likely not based on the rest of the thread, but at least I've said my peace about it. With that, I'm done and I hope it is resolved for you and no one gets hurt.

OK, so let's break this down for a moment...

You've been taken for a ride and I'm sorry that you and others have been. I have been in the past as well and I allowed the proper authorities to handle it each time. In one instance it took over a year. I do know how it feels and I do know what it's like. I didn't, however, rant for 5 months on a public board about it and suggest that people go to their house, find them, confront them, or whatever else.

Gathering the names of others taken for their money, acquiring amounts they were taken for, gathering receipts and dates of payments made, gathering e-mails of the back and forths to the seller are all good things to do to have enough information to go to the authorities. Past that, let them handle it. They have more tools at their disposal than either you or I do to get done what needs to be done. Including, but not limited to, finding out his real name.

What isn't a terribly smart idea is the whole "hey, I have his address...let's all go and confront him". Like I said, it only takes them feeling threatened for something bad to happen. If that's what you want, then I certainly can't stop you. It's merely a suggestion about YOUR safety as well as the safety of others. I don't know about you, but I wouldn't roll up to someone's house making demands unless I REALLY knew that person. I don't know what toys they own and I wouldn't want to find out the hard way.

I never said you had to stop pursuing it, but you may want to consider handling it by contacting those also affected and gathering your information outside of a thread. That way, you can be in contact with those who need your help and you don't have to worry about others (namely the gentleman you're trying to find) knowing about everything that is going on with the process.

You may take my comments however you wish as they really weren't meant as a slight towards you. I will say though that poking fun at my signature is a lawltastic attempt at angering me. Next time try it with a little more feeling.

I am not trying to poke the bear here, but I think that we have all done as much as we legally can. I wish to leave it in the hands of the authorities. Another thing I have talked with Gary enough to know he is playing us all. The reason the one on face-book is not giving his real name because that is Gary. The man tried to pull the same thing when I first called him and he picked up, only to back peddle after a few minutes of talking to me. This man is never going to give us a straight answer, and that's his M.O. gentlemen. This man is a compulsive liar and is going to tell us what ever he thinks will get us to leave him alone, trust me my degree work is in psychology and I see these people all the time. Confronting him in person is only going to hurt any legal chance we may have in the future as well as put any of us in a situation that compromises our safety. This man has no business registry so there is nothing to hurt there, the resin can be bought online and shipped to a home. This guy is working out of a garage so there is no business to hurt. Have faith the legal system moves slow but it does move. It could be years before we see anything out of this, but i guarantee you this his name is registered and he will find it much harder to pull this over on someone else.

What I find interesting about this guy is that people buy from him all the time. I have seen the bust on several " collection " pictures and wonder why they aren't getting it for buying them. The images always look good but I wouldn't dare buy from him...him and chaucer44 guy as well. people will always buy from guys like this because the prices are cheaper vs. the crazy prices retailers have. just a fact of life sadly

When i bought those props, i did not know who the original makers were......

The amazing thing is that ebay still lets them work with them time after time.....

But the thing is, why not joint efforts in order to make the law work for us?

I have not had any luck. Every time I call his number i get no answer, and text i keep getting back the same reply "its on its way". Personally we are chasing a ghost. It seems to be going no where. I hate it, and i cant stand to be cheated, but i see no end to this. I really don't know what else to do, and I have moved on.

Sorry to bring up an old thread. Just wanted to say that this guy ripped me off as well, on ebay. Bought a pulse rifle model about a year ago, around $100. As others have said he just stalls until its too late to do anything. Guess I wont be giving anyone the benefit of the doubt anymore. Ive complained to ebay, paypal, and IC3 to no avail. Even talked to a local police officer (I live in Wisconsin), nothing seems to have come of that. Anyways you have another supporter, and I'm glad this forum is one of the first hits after googleing his name so that word can spread about how much of scumbag he his.

I just muddled through this whole thread and here is my advice to all who were ripped off by this a-hole: You will NEVER get your items nor will you EVER get your money back. The facebook guy IS the same guy (it's plainly obvious by his response to Madrid). Do what I do.... I never spend more online from someone I don't know than what I'm WILLING to flat out lose. And don't buy off eBay, just like everybody's been saying here for years. The biggest losers on eBay and Paypal are the people running them. They will be no help for anything. As long as they get their cut they're happy.

The Darth Maul bust is a recast off Cyberman's one.

there are a couple of sellers on eBay now that seem to be selling a some of the same things everyones favorite thief sold. Cylon_trader started seller just last year after we all had problems and Hollywoodpropmaster started just this year. The pics for the items even look the same. even if they are not gary I am tired of re-caster selling this garbage. everyone may want to be careful if you have seen them online.

Well, I googled him, and a kid is getting made to be the bad guy because he unknowingly bought a recast of someone elses work on the RPF from guess who... our favourite ebay seller: fan_made.
