Im choking here!

Ok so I'm having a severe choking problem. I wasn't sure of it was the vest, or the collar armor, so I took the vest off and just did the jp harness and back/collar. It is still happening, so not the vest. I know my current harness is junk, but it's what I have for now. As you can see in the pics below, it happens when I just have the back plate on without the jp. When the jp is on, it's ridiculous.

Any suggestions? Am I doing something wrong?

The bottom straps of the harness need to be around your waist. With the harness sitting so high, just you breathing in pushes the harness around your neck. In short the harness is too short
 
The harness isnt chocking him its the collar armor...the collar and backplate shouldnt be attached to the harness really just kinda floating over it, the collar should attach to the vest though to hold it down and away from your neck. Your upper straps might need to go out a little but I cant really tell, a metal harness rig would help all of this alot though
 
I think I see your problem mate. How much clearance would you say you need for it to stop choking you?
How much overlap is there where the collar and the backplate join? It looks to me like you've got about 1 - 1.5 inches.
Is it possible to slide the collar forward a bit to give a little more room and reattach it?
You'll want it to have a good half inch of overlap left so that it'll have enough structural integrity to hold together otherwise it might snap.
If it doesn't have enough give you might consider putting in a shim and have the collar and the backplate butt up to each other.

Yup... That's exactly what's wrong... It's just bolted too far back (for you). Looks like it was put together for someone else. Did you buy it used/pre-assembled?

Yes I did buy it secondhand. I guess that makes sense, lol. I may just need to buy a new collar because I don't think there is room for more holes. I'll try shimming first.
